Hungry and Homeless: the impact of the withdrawal of state support on asylum seekers, refugee communities and the voluntary sector [April 2004]
Under Section 55 of the Nationality, Immigration and Asylum Act 2002, destitute asylum applicants can be denied access to asylum support if they are unable to prove that they applied for asylum "as soon as reasonably practicable" after entering the UK. This regulation has been used to deny basic state support to people who have applied within days and sometimes even within hours of arrival, many of whom are particularly vulnerable and in genuine need of international protection. With funding from Oxfam, the Refugee Council has conducted a survey investigating the real impact Section 55 is having on asylum seekers, charities and the refugee community, one year after its implementation. This report presents the findings of this research and reveals that Section 55 is, in fact, forcing many asylum seekers into destitution and placing an unsustainable burden on the voluntary sector and refugee community.
