Asylum process

The UK asylum determination process is a legal process. Most queries and/or difficulties your client may have within the asylum determination process should be taken up by a qualified, and OISC certified, immigration solicitor.

However, there are scenarios where you, as an advisor, can assist or advise your client.

This section covers:

  • Applying for asylum
  • Segmentation and the New Asylum Model
  • Legal advice
  • Home Office interviews (including travel)
  • Further representations and new evidence
  • Waiting for a decision
  • Reporting
  • Detention
  • Appeals
  • Voluntary return
  • Contacting family members abroad
  • Further resources

Asylum process for unaccompanied children

Unaccompanied asylum-seeking children are young people aged under 18 who are not accompanied by a parent or guardian, and who apply for asylum.

With the changes to the asylum process with the New Asylum Model, also come proposals for a new process to handle asylum applications from children. The asylum process for unaccompanied children seeking asylum will continue to differ slightly to take account of children and young people's particular vulnerability.

This section covers:

  • Claiming asylum
  • Screening
  • Assessing age
  • First reporting event
  • Asylum interview
  • Legal representation
  • Asylum decisions (covers both refusals and positive decisions)
  • Further resources
